General terms and conditions

These general terms and conditions (hereafter referred to as “GTC”) apply as of right, to any product sale of the Hédène brand (hereafter referred to as “the product(s)”) realized by the SAS MNR under the commercial name Hédène (hereafter referred to as “Hédène”) a simplified joint-stock company with a share capital of € 31,500.00, registered under the number 795 089 507, with a registered office at 14 rue Charles V, 75004 Paris. Its phone number is +33(0)6.15.50.64.23 and its email address is contact@hedene.fr and its VAT identification number is FR 24 795089507.

1/ Opposability of the general conditions of sale

The GTC apply to every order of products from October 1st, 2017. Any change in the GTC will not be applicable to orders confirmed before the date of the changeover.

2/ Creation of a customer account

Any natural person wishing to place an order on the Site must create a customer account.

When creating his account, the Customer must provide the items requested. He undertakes, as such, to provide only accurate information and to inform Hédène of any change that may affect them afterwards, by sending, without delay, an email to the address contact@hedene.fr.

The Customer undertakes to keep secret and to disclose to anyone the username and password created when opening his account. He is solely responsible for the use of the Site made through his username and password. In case of fraudulent use of his username and / or password, the Customer undertakes to notify Hédène, without delay, by email to the address contact@hedene.fr.

3/ Ordering products on the Site

Products offered for sale are described and presented as accurately as possible. Hédène reserves the right to correct the content of the Site.

The Customer is informed that he will have to select the product(s) he wants to include in his cart.

After having selected the product(s) that the Customer wishes to buy in his cart (of which he can modify the content at any time), a reminder of the content of the order is proposed to the Customer.

The Customer confirms his acceptance of his order by checking the validation box of the GTC. The contract is then validly concluded between Hédène and the Client.

The Customer proceeds to the payment of his order, by using one of the payment solutions which are proposed to him (only French bank cards). To proceed with the payment, the Customer enters the details of delivery of the Product(s) and, billing, if they are different.

The Customer must ensure that the communicated information is correct and that it remains correct until complete delivery of the Product (s) ordered (s). The Customer undertakes to inform Hédène of any change in billing and/or delivery details that may occur between the order and the delivery, by sending, without delay, an email to the address contact@hedene.fr. Failing this, in case of delay and/or error of delivery, all expenses incurred for the return of said Product(s) will be charged to the Customer.

Hédène sends an order confirmation by email to the Customer.

4/ Price

The prices are mentioned on the Site in the product descriptions in euros and all taxes included.

5/ Delivery

Products displayed on the Site can be delivered to Metropolitan France exclusively.

Hédène agrees to deliver the Products within a period not exceeding 30 days from the date of order. The ordered Product(s) is (are) delivered to the delivery address indicated by the Customer when ordering.

6/ Right of withdrawal

Without prejudice to the legal provisions relating to the conformity of products or hidden defects, the Customer has a period of 14 days from the receipt of the Product(s) ordered to exercise his right of withdrawal from Hédène, without having to justify reasons or to pay a penalty.

To exercise its right, the Customer must return, at its expense, the Product(s) in good condition and with all the packaging elements, accessories and notices (even if the Product (s) has or have been unpacked) at the following address: 7 boulevard de Stalingrad 92320 Chatillon. We encourage The Customer to indicate the reason for return, in order to help Hédène to improve its service.

The refund of the Product(s) returned is made by Hédène by credit on his credit card or credit note according to the choice of the customer, and at the latest in the 14 days following the date on which the right of retraction was exercised.

7/ Customer service

For any request of information, clarification or for any claim, the Customer must contact, in priority, the customer service of Hédène, to enable the latter to try to find an amicable solution.

8/ Responsibility

Hédène implements all the measures necessary to ensure to the Customer the supply, under optimal conditions, of Quality Products. However, it cannot under any circumstances be held liable for any non-performance or poor performance of all or part of the services provided in the contract, which is attributable either to the Customer or to the unpredictable and insurmountable event of a third party who is not a party to the contract, or a case of force majeure. More generally, if Hédène's liability were incurred, it could in no way agree to compensate the Customer for indirect damages or whose existence and / or quantum would not be established by evidence.

Hédène ensures the proper functioning of the Site, but is not responsible in case of any anomalies or errors resulting from a fraudulent interference on the part of a third party leading to a modification of information available on the Site and more generally speaking in case of any kind of direct or indirect anomalies, whatever their causes, origins or consequences are, caused by the access to the Site by anyone or the impossibility of accessing or using the Site and/or the credit given to any information resulting directly or indirectly from the latter. 

9/ Personal data & Intellectual property

The information provided on the Site allows Hédène to process and execute orders placed on the Site and, where applicable, to manage the operation of the Customer area.

In accordance with Article 32 of the Data Protection Act of 6 January 1978, Hédène informs the Customer of the use made of the personal data collected in the context of your orders by permanently making available to the Customer a "Privacy policy", accessible via a hypertext link at the bottom of all pages of the Site.

10/ Applicable law

These Terms are subject to French law. Only the French courts are competent to know their interpretation and / or execution.
